Environment
Environmental law plays an increasingly critical role in both regulatory compliance and corporate risk management, particularly in industries such as agribusiness, energy, infrastructure, manufacturing, and natural resources. At Leks&Co, we provide a comprehensive suite of legal services designed to help our clients navigate the complex and evolving environmental legal landscape in Indonesia. Our practice is focused on delivering both preventive and responsive solutions—ensuring regulatory compliance while also representing clients in high-stakes environmental disputes.
We assist clients in understanding and complying with environmental regulations, including laws related to environmental impact assessments (AMDAL), permitting processes, hazardous waste management, forest area utilization, and emissions control. Our advisory services often address corporate environmental obligations, sustainable business practices, and legal risks related to land conversion, industrial development, or resource extraction. We also conduct legal reviews of environmental liabilities during due diligence processes for M&A or land acquisition transactions.
In addition to advisory services, we represent clients in environmental litigation and administrative proceedings before Indonesian courts and government authorities. Our litigation experience includes challenges to administrative decisions issued by the Ministry of Environment and Forestry and defense in enforcement actions involving environmental violations. We are also equipped to handle legal strategy in response to sanction mechanisms such as environmental permit revocation, corrective action obligations, or forest area relinquishment challenges.
We have handled several significant environmental disputes on behalf of leading companies. For instance, we represent PT Pacific Indopalm Industries (part of the Indomas Group) in an environmental dispute in Siak, addressing complex issues related to land use and environmental liability. We also represent PT Kartika Cipta Pratama and PT Megakarya Jaya Raya in proposed legal actions challenging the Minister of Environment and Forestry’s decisions issued in November 2022, which imposed additional commitments regarding previously relinquished forest area licenses. These matters underscore our ability to assist clients in navigating government action, regulatory uncertainty, and reputational risk in the environmental domain.
As part of our thought leadership in this field, Leks&Co regularly publishes legal insights on evolving environmental matters. Notable articles include: “Reforming Environmental Supervision and Sanctions: Key Points and Discrepancy Whether Environmental Approval is Required for Building Approval,” “The Role of an Individual in Environmental Litigation: Legal Standing in State Administrative Court Jurisprudence,” and “Navigating ESG in Indonesia: The Absence of a Regulatory Framework.” These publications reflect our ongoing commitment to shaping legal discourse and advancing sustainable legal practices in Indonesia.
