Our experience covers numerous contract types such as consulting agreements, joint ventures, service agreements, lease agreements, and construction contracts—including those based on FIDIC standards. We take a practical and commercially focused approach to every engagement, ensuring that our clients are well-informed and well-protected throughout the contract lifecycle.

Our services are not limited to the formation of contracts. We assist clients during the negotiation process, offer strategic legal opinions on contractual terms, and advise on risk mitigation in both domestic and cross-border arrangements. In cases of dispute, we provide legal support in arbitration and litigation involving breach of contract, performance issues, or conflicting interpretations.

Leks&Co has extensive experience in advising clients on general contract matters across a range of industries. We were retained by the Lippo Karawaci Group of Companies to draft, review, and standardize various operational contracts used in the ordinary course of business. For PT Semangat Sejahtera Bersama, known for its ā€œAdvanceā€ health brand, we assisted in reviewing and standardizing business contracts involving labor, foreign investment, and other corporate matters.

We also advised PT Bliss Properti Indonesia, a growing real estate company, in standardizing operational contracts, with particular emphasis on commercial lease agreements. Our legal services to PT Cushman & Wakefield Indonesia included reviewing and translating a series of project-related contracts to ensure compliance with Indonesian law. In addition, we supported PT Takenaka Indonesia by reviewing subcontract agreements and advising on proposed revisions to contractual correspondence. These matters demonstrate our firm’s capability in handling a wide range of general contract needs, from day-to-day operational documents to complex commercial arrangements.

Our firm recently achieved two major successes in contract-related litigation. First, Leks&Co Triumphs in Cassation on Contractual Termination Dispute. The core of the dispute centered on whether a binding contract existed. The courts agreed with our position that no legally enforceable agreement had been formed, as the parties were still in the negotiation phase. The Supreme Court confirmed that without a concluded contract, no breach could be established, thereby rejecting the Claimant’s cassation.

As noted by our Managing Partner, Dr. Eddy M. Leks: ā€œWe are grateful for these wins. We learn that to claim for a breach of contract, an existence of contract must be proven. When there is no contract, no binding legal relationship, means no breach of contract. This is the essence of the legal arguments by Judex Facti and Judex Juris.ā€. Second, we prevailed in a cassation before the Supreme Court in a construction contract dispute, further affirming our capability in contract litigation at the highest judicial level in Indonesia.
