Dr. Eddy Marek Leks, Managing Partner of Leks&Co, was honored to be a speaker in an online webinar titled “Dinamika Penyelesaian Sengketa Non-Litigasi terhadap Agunan pada Fasilitas KPR” organized by The Alternative Dispute Resolution Institution for the Financial Services Sector (LAPS SJK). LAPS SJK is an out-of-court dispute resolution body established by Self-Regulatory Organizations (SROs) and various associations within the financial services sector.

As one of the speakers, Dr. Leks, Managing Partner of Leks&Co, this webinar discussed the importance of non-litigation mechanisms such as mediation, arbitration, and binding opinions to resolve the rising disputes over mortgage collateral, particularly delays in certificate handover, that have raised concerns across the housing finance sector. Dr. Leks highlighted legal issues involving agreements between banks, developers, and consumers—ranging from unfulfilled obligations in preliminary sales agreements (PPJB) to developers’ failure to transfer land certificates after mortgage repayment. Court precedents have shown that banks and developers can be held jointly liable in these cases, with damages awarded to consumers for breach of contract and unlawful acts.

To mitigate such disputes, financial institutions are urged to uphold prudential principles and enforce stricter requirements for developer compliance, while consumers are advised to actively monitor their property documentation and seek clarity on handover timelines and legal protections. POJK regulations and the expanded role of LAPS SJK now offer structured avenues for dispute resolution, ensuring consumer rights are protected and market trust is maintained. This development marks a critical step in reinforcing consumer protection in Indonesia’s housing finance sector, encouraging stakeholders to embrace preventive legal compliance and responsible lending practices.
