The case concerned a dispute relating to the breach of contract.
Acting as legal counsel for the Defendant and the Co-Defendants, Leks&Co presented a comprehensive defense and raised a jurisdictional objection based on the arbitration clause contained in the underlying agreement between the parties. The defense emphasized that the parties had contractually agreed that any dispute arising from the transaction would be resolved through arbitration rather than through the district court.
In its consideration, the Court ruled that, pursuant to the arbitration clause agreed by the parties and the provisions of Law No. 30 of 1999 on Arbitration and Alternative Dispute Resolution, the dispute falls within the competence of arbitration. Consequently, the Court declared the Plaintiff’s claim as inadmissible. The judges ruled on the pacta sunt servanda principle that an arbitration agreement is binding and must be honored by the parties.
