Jakarta, January 2024. Our Managing Partner and Associate of Leks&Co, Dr. Eddy Leks and Ardelia Ignatius, wrote an article titled “Regulation Updates: Policies of Supreme Court in 2023 on E-Court System” as published in Lexology.com

The Supreme Court in Indonesia introduced two pivotal policies in 2023, aiming to bolster the functionality and efficacy of the electronic court (e-court) system. The Circular No. 1/2023 outlines procedures for summons and notifications via registered letters, enhancing the speed and affordability of the process. However, it raises queries about handling summons for enterprises involved in cases. Meanwhile, the Decree No. 207/2023 provides technical guidance for the electronic submission and handling of cassation and judicial review applications. These regulations mandate electronic submissions for all cases and emphasize the need for completeness and clarity in documents. While these policies signify the Supreme Court’s commitment to accessible and swift court proceedings, there’s a call for further enhancements in the e-court system’s functionality beyond policy implementation.
