The webinar, titled “Construction Disputes in Major Infrastructure Projects: Arbitration Perspectives” was successfully held on April 21, 2026, and was attended by legal professionals, construction practitioners, and key infrastructure stakeholders.

In his presentation, Dr. Eddy M. Leks highlighted the rising trend of construction disputes in Indonesian mega-infrastructure projects driven by factors such as macroeconomic dynamics, technical defects resulting from “fast-track” pressures, financial frictions leading to cost overruns, and legal ambiguities within contracts and Bills of Quantities (BoQ). He also emphasized the importance of Multi-Tier Resolution Mechanisms such as negotiation, mediation, and Dispute Adjudication Boards (DAB) before initiating formal arbitration.

He also provided a profound analysis of the Constitutional Court (MK) Decision No. 100/2024. The removal of the word “deemed” (dianggap) from Article 1 point 9 of the Arbitration Law provides stronger legal certainty regarding the territorial principle, aligning Indonesian practice more closely with international arbitration standards. Eventually, the session covered strategies for drafting effective arbitration clauses and highlighted updates in the 2025 BANI Rules, specifically regarding the introduction of Emergency Arbitration mechanisms which allow for swift and binding interim measures before a tribunal is constituted.
