Jakarta, May 2025. Leks&Co, a leading Indonesia dispute law firm, has successfully defended our client, PT Coca-Cola Bottling Indonesia, a multinational beverage manufacturing company, in an administrative land dispute.
The dispute concerned the annulment of a land title of right of management (hak pengelolaan) issued in 1982, with the Claimants seeking to have the certificate declared as invalid and revoked. The case was initially granted at the first instance by the Administrative Court in Bandung (Decision No. 130/G/2023/PTUN.BDG), but was later overturned by the Jakarta High Administrative Court. The Claimants subsequently filed a cassation to the Supreme Court.
As was in the appeal case, our team argued that the cassation was inadmissible due to late filing beyond the statutory time limit, and further submitted that the substance of the dispute related to land ownership, which falls under the jurisdiction of the general courts—not the administrative courts. The Supreme Court, through Decision No. 106 K/TUN/2025, affirmed the judgment of the Jakarta High Administrative Court and rejected the cassation. The Supreme Court found that the lawsuit had been filed beyond the deadline under Article 55 of Law No. 5 of 1986 on State Administrative Courts.
